Compulsory Purchase is when the Government, Local Council or Utility company establishes a legal right to buy or take rights over a private property. Examples of public or private construction projects include housing development, airport expansions, flood defence works, rail or road building projects, electricity pylons and cables, etc.
Compensation is paid to reflect the losses and disturbance caused by a compulsory purchase or statutory scheme on an owner or occupier’s property.
Compensation is based on the owner or occupier being returned to a position no worse or better off than if the scheme had not happened and it is up to the claimant to provide any losses as part of a valid compensation claim.
In most cases, the acquiring or statutory authority will pay Chartered Surveyors reasonable fees for negotiating a claim.
